These Terms govern access to the hosted Nexly analytics service, dashboard, APIs, SDKs, reports, and related features. In these Terms, “Nexly”, “we”, and “us” refer to the service offered under the Nexly name at nexly.to.
By creating an account or using the service, you agree to these Terms. If you use Nexly for an organization, you confirm that you have authority to accept these Terms for that organization.
Accounts and access
- Provide accurate account information and keep it current.
- Protect passwords, passkeys, recovery codes, API tokens, ingest keys, and active sessions.
- You are responsible for activity performed through your account and by team members you invite.
- Tell us promptly at mail@nexly.to if you believe an account or credential has been compromised.
Acceptable use
You may use Nexly only for lawful purposes and in compliance with laws that apply to you, your properties, and your visitors. You are responsible for the notices, lawful bases, and consent mechanisms required for your use of analytics.
- Do not use Nexly to violate privacy, data protection, intellectual property, or other rights.
- Do not probe, disrupt, overload, reverse engineer, or bypass service limits or security controls except where applicable law expressly permits it.
- Do not send payment card data, government identifiers, credentials, health records, precise location, or other highly sensitive data.
- Do not put personal data or secrets in page paths, URLs, event names, custom properties, or report titles unless you have a lawful and documented reason to do so.
Customer data and instructions
You retain ownership of the analytics data, configuration, content, and custom events you submit to Nexly. You grant us the limited right to process that data to provide, secure, maintain, and support the service.
For analytics data collected from your properties, you determine what to collect and why. Nexly processes that data on your instructions as described in the Data Processing Agreement and Data Policy.
We do not sell customer analytics data or use it to build advertising profiles.
Plans, billing, and taxes
Plans differ primarily by monthly event allowance. Current prices, billing periods, and included usage are shown before checkout. Polar provides checkout, subscription management, invoices, tax handling, and payment processing.
Paid subscriptions renew for the selected billing period until cancelled. You can change or cancel a subscription through the available billing controls. The timing and financial effect of cancellation are shown in the billing flow and remain subject to mandatory consumer rights.
We may change plans or prices. Material changes affecting an active paid subscription will be communicated before they take effect.
AI Insights
When you use AI Insights, your prompt and the analytics context needed to answer it may be sent to the selected model provider. AI output can be incomplete or inaccurate and must not be treated as legal, financial, medical, or other professional advice.
You are responsible for reviewing AI output before relying on or sharing it. Do not include sensitive personal data or confidential information in prompts.
Service changes and availability
We work to keep Nexly available and reliable, but the service is provided on an “as available” basis. Maintenance, provider incidents, network failures, and software defects may cause interruptions or data delays.
We may add, change, limit, or discontinue features. When a change materially reduces a paid service, we will use reasonable efforts to provide advance notice.
Suspension and termination
We may limit or suspend access to protect the service, respond to legal requirements, address non-payment, or stop a material breach of these Terms. Where practical, we will provide notice and an opportunity to resolve the issue.
You may stop using Nexly at any time. Account closure and privacy deletion requests are handled through mail@nexly.to. Deleting a property in the dashboard disables access and ingestion but is not, by itself, an immediate purge of underlying analytics storage; see the Data Policy.
Disclaimers and liability
To the maximum extent permitted by applicable law, Nexly is provided without implied warranties of merchantability, fitness for a particular purpose, or uninterrupted operation.
To the maximum extent permitted by law, Nexly will not be liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, revenue, goodwill, or data. Nothing in these Terms excludes liability that cannot legally be excluded.
Changes and contact
We may update these Terms to reflect product, legal, or operational changes. The updated date will appear at the top of this page. Material changes will be communicated through a reasonable channel.
